End User License Agreement

The licence for every app D.E.O.N. INVESTMENT LTD publishes on the App Store and Google Play. It is laid out like an app’s permission manifest: first what you are allowed to do, then what you are not, then the conditions that come with the licence, and finally the extra terms each store requires.

By installing or using the app you accept this licence. If you do not accept it, do not install the app, or delete it. An app may come with additional terms shown inside it; they apply together with this licence.

G · GrantedWhat you may do

  • install.use Install and use the app on devices that you own or control, for your own personal, non-commercial purposes — for App Store downloads, within the limits of Apple’s Usage Rules described in section A.
  • updates.receive Receive the updates we release. Updates may add, change or remove features.
  • content.keep Keep what the app helps you create. Your own content remains yours; we claim no ownership of it.

D · DeniedWhat you may not do

  • copy.modify Copy, modify, translate or create derivative works of the app, except where the law gives you that right regardless of this licence.
  • reverse.engineer Decompile, disassemble or reverse-engineer the app, or try to extract its source code or its machine-learning models, except to the extent the law expressly allows despite this restriction.
  • redistribute Rent, lease, lend, sell, sublicense or otherwise pass the app to someone else.
  • bypass Get around the app’s security, purchase checks or usage limits, or reach the services behind it with bots or other automated means.
  • misuse Use the app to break the law, infringe anyone’s rights, harass people, or produce or spread unlawful content.
  • notices.remove Remove or alter copyright, trademark or other notices in the app.

C · ConditionsConditions attached to the licence

C1 · Licensed, not sold

The app is licensed to you, not sold. We and our licensors keep all rights in it that this licence does not expressly grant to you.

C2 · Purchases and subscriptions

Paid apps, in-app purchases and subscriptions are sold and billed by Apple or Google, at the price shown in the store at the time of purchase. Subscriptions renew automatically until you cancel them in your App Store or Google Play account settings; cancelling stops the next renewal, not the current period. Refunds are decided by the store under its own policies.

C3 · AI features

Some apps contain features powered by machine learning. Their results are produced automatically and can be wrong, incomplete or out of date. Check a result before you rely on it, and do not use it in place of advice from a qualified professional on medical, legal, financial or safety matters. You are responsible for what you submit to such a feature and for how you use what it returns. Whether a feature runs on your device or sends data to a server is described in the app’s privacy information.

C4 · Your data

Our Privacy Policy and the privacy details of each app explain what data the app handles and why.

C5 · Services run by others

The app may need an internet connection and may rely on services run by other companies, each under its own terms. We are not responsible for those services or for any charges your mobile operator makes for data.

C6 · Changes and availability

We may change the app, suspend a feature or stop offering the app. Where the law requires it — for example, for a subscription you have already paid for — we will give you notice and keep to your statutory rights.

C7 · End of the licence

This licence runs until it is brought to an end. Deleting the app ends it from your side at any moment; a breach of its terms ends it automatically. Once it is over, uninstall the app and stop using every copy of it.

C8 · Warranty

Beyond the warranties that law makes compulsory, we give none: so far as the law permits, the app comes “as is” and “as available”. Consumers keep, untouched, their statutory rights over digital content that turns out to be faulty.

C9 · Liability

Where the law permits, we carry no liability for indirect or consequential losses, nor for lost data, profits or goodwill connected with the app. Liability that no contract may restrict — for instance for fraud, or for death or personal injury resulting from our negligence — is not restricted by anything in this licence.

C10 · Sanctions and export

You may not use or export the app in breach of sanctions or export-control laws that apply to you or to us.

C11 · Governing law

Cypriot law governs this licence, and the courts of Cyprus have jurisdiction over disputes about it. If you are a consumer, you also keep the protection of the mandatory law of the country where you live and may bring proceedings there.

A · App StoreTerms that apply when you got the app from Apple

The points below apply to apps obtained from Apple’s App Store. Where they conflict with anything else in this licence, they prevail.

  1. Parties. The parties to this licence are you and Deon; Apple is not one of them. Responsibility for the app and everything in it lies with Deon and not with Apple.
  2. Scope. What you receive is a non-transferable right to run the app on any Apple-branded device you own or control, within the Usage Rules set out in Apple’s Media Services Terms and Conditions. Accounts tied to the buyer through Family Sharing or volume purchasing may use the app as well.
  3. Maintenance and support. Maintenance and support for the app, to the extent this licence describes them or the law demands them, come from Deon alone. Apple owes no maintenance or support of any kind.
  4. Warranty. Every warranty attached to the app — written out or implied by law, and not validly excluded — is Deon’s alone to honour. Should the app not match a warranty that applies to it, you can tell Apple, which will then refund any purchase price you paid. Beyond that refund, and as far as the law permits, Apple carries no warranty duty for the app at all; every other claim, loss, liability, damage, cost or expense arising from a warranty failure falls to Deon.
  5. Product claims. Any claim — yours or someone else’s — connected with the app, or with your having or using it, is for Deon to address, not Apple. That covers product liability, allegations that the app breaches a legal or regulatory requirement, and claims brought under consumer protection, privacy or comparable legislation.
  6. Intellectual property. Where someone alleges that the app, or your having and using it, infringes their intellectual property, the investigation, defence, settlement and discharge of that allegation rest solely with Deon, and not with Apple.
  7. Legal compliance. You confirm and warrant two things: you are not in a country under a US Government embargo or named by the US Government as a “terrorist supporting” country, and your name does not appear on any US Government list of prohibited or restricted parties.
  8. Developer contact. Send any question, complaint or claim about the app to D.E.O.N. INVESTMENT LTD, LUMIEL BUILDING, Floor 4, 61 Lordou Vyronos, Larnaca, Larnaca 6023, Cyprus, or by e-mail to support [at] deon-investment.com.
  9. Third-party terms. Using the app does not suspend other agreements that bind you — your mobile data plan, for instance — and you need to keep to them while you use it.
  10. Third-party beneficiary. Apple, together with its subsidiaries, benefits from this licence as a third party. On your acceptance, Apple gains — and is treated as having accepted — the right to enforce the licence against you in that capacity.

P · Google PlayTerms that apply when you got the app from Google Play

  1. Store terms. Your use of Google Play, including buying and downloading the app, is also governed by the Google Play Terms of Service. Google is not a party to this licence and is not responsible for the app.
  2. Payments and refunds. Google Play processes purchases and subscriptions, and refunds follow Google Play’s policies. You manage or cancel subscriptions in the Google Play app.
  3. Your store rights. Nothing in this licence reduces rights you have under the Google Play Terms of Service.
